Urgent questions

Updated for RD 1155/2024 and the RD 316/2026 reform

Residencia España Abogados · Interactive guide

Unable to continue your studies in Spain for financial reasons? Your legal roadmap.

Article 190 requires the relevant qualification or certificate for the change of status it regulates. If you cannot finish, alternative residence and work routes may be worth reviewing. Student stay does not, on its own, count as residence for citizenship.

Specialist consultation: €50, deducted from the legal fees if you instruct us.

01 · Your starting point

Initial guidance for your case

Up to four questions about family ties, qualifications, time in Spain and your circumstances. The result identifies a route to review, not a granted permit.

Before withdrawing from your course or making a decision about your permit, review the consequences with a lawyer.

Question 1 of up to 4

Do you have a Spanish or EU partner, or are you under 26 and the child of a Spanish national?

Marriage, registered partnership or proven stable cohabitation may be relevant. Spanish and EU family regimes differ.

Information only, not a legal opinion. Answers are neither sent nor saved. The result does not establish eligibility or authorise work.

Before applying for arraigo

Key rule under RD 316/2026: incompatibility in Article 126.h)

Article 126.h) requires that you do not hold a stay or residence authorisation and are not an interested party in proceedings for granting, extending, renewing or modifying such authorisations. A valid student authorisation or pending proceedings may prevent access to arraigo.

An expired TIE alone does not establish eligibility. Pending appeals or applications require an assessment of their effects. Do not withdraw applications or deliberately let your authorisation expire without legal advice.

Withdrawing from a course, even with documented financial reasons, does not create a residence permit or guarantee preservation of your stay.

02 · The alternatives

Explore seven routes for review

Requirements are cumulative and depend on the case. The required time in Spain must be completed before applying; being close to two years is not enough.

01

Residence as a family member of a Spanish or EU national

Arts. 93–99 · RD 1155/2024 / RD 240/2007

Family ties may open a route without waiting two years. First identify the applicable Spanish or EU regime.

  • The Spanish family regime may grant up to five years.
  • Marriage, registered partnership and stable partnership each require specific evidence.
  • In certain Spanish-regime cases, acceptance for processing permits provisional work; not all relatives qualify.

No immediate grant is guaranteed. Age, dependency and regime-specific requirements must be checked.

02

Highly qualified professional (UGE-CE)

Arts. 71, 76 · Ley 14/2013

A qualified offer and education or experience may allow this route without two years in Spain.

  • The permit may last three years, adjusted for shorter contracts under the law.
  • Law 14/2013 sets a twenty-day maximum and positive administrative silence, subject to calculation and suspension rules.
  • Granted legal residence may count for citizenship if continuity and all other requirements are met.

An offer and degree alone are insufficient. Salary, role, qualifications and lawful status must be checked; this test establishes neither silence approval nor work permission.

03

Employment-based residence (Arraigo sociolaboral)

Art. 127.b · RD 1155/2024

Review this route after completing the required stay and obtaining qualifying contracts.

  • One or more contracts totalling at least 20 hours a week.
  • SMI or collective-agreement pay proportional to hours worked.
  • Acceptance for processing provisionally permits residence and employee work while the application is decided under current law.

Nearly two years is not enough. Complete the period before applying and check Article 126.h and employer requirements.

04

Social residence route (Arraigo social)

Art. 127.c · RD 1155/2024

Specified family ties, funds and, where relevant, integration evidence and a self-employment project may support this route.

  • With qualifying family ties, prove at least 100% of IPREM under the applicable legal scenario.
  • Without the specified ties, integration efforts are assessed through the relevant report.
  • Self-employment requires a viability review and compliance with applicable requirements.

Not any family support or business plan guarantees approval. Check qualifying relationships, available funds and administrative status.

05

Training-based residence (Arraigo socioformativo)

Arts. 127.d, 131 · RD 1155/2024

Recognised training may offer an alternative if stay and integration requirements are met.

  • Check eligible FP and professional certificates, including public or subsidised places where available.
  • Provide enrolment or a permitted training commitment and an integration report.
  • The granted permit allows employee work up to 30 hours a week under legal conditions.

Not every SEPE course qualifies; free places are not guaranteed. Enrolment or filing alone does not grant work permission.

06

International protection and possible humanitarian grounds

Ley 12/2009

Persecution or serious risk requires an individual protection assessment; humanitarian grounds are separate legal categories.

  • Document personal facts and risks with specialist advice.
  • Verify work entitlement in issued documents and at the relevant procedural stage.
  • Protection applications may affect the stay calculation and access to arraigo.

Do not seek asylum just to gain time or for financial hardship. Do not withdraw a claim without assessing risks and effects.

07

Documented, good-faith transition strategy

If no immediate route appears, review authorisation, deadlines and continuation options before withdrawing.

  • Document unexpected financial circumstances and communications with the institution.
  • Consider scholarships, deferrals, changing studies and compatible alternatives.
  • Prepare a review schedule and stay evidence; municipal registration is not legal residence.

Good-faith withdrawal does not preserve stay or automatically protect a case. Do not deliberately let your permit expire to seek arraigo.

Prepare your case review

  • Passport, TIE, decisions and evidence of any pending application.
  • Enrolment, academic certificates and evidence of unexpected difficulties.
  • Historical municipal registration, travel, family ties and job offers, if available.

Your next step, with legal clarity

We review your authorisation, deadlines and documents to assess an alternative suited to your actual situation, without promising outcomes.
